Ker malo ljudi zna dobro govoriti nemščino sem prevedel splošna pravila v angleščino (žal ne v slovenščino). Uporabil sem altavistin prevajalnik, tako da so nekateri stavki čudno obrnjeni, nekatere besede pa niso prevedene. Če jih hoče kdo dodatno, naj mi pove in bom editiral. INSURANCE

Because of again and again the questions to the insurance protection, near-carried at us, the German model flier informs federation e.V. with this small brochure about the existing insurance offer. If further questions arise, turn please to the office of the DMFV under Tel.: 02 28/ 97 85 00.

1. Necessary conditions:

1. Only members of the DMFV can have in the context of the existing membership the insurance benefits. The insurance expires with the loss of the membership in the DMFV. Those in the following specified insurance benefits become effective only if the member follows his liabilities from the membership up to the statutory specified date (31.01. of each financial year). With new members the period ran off one month for payment at the latest after account creation.
2. Insurers for all in the following specified liability right protection and accident insurances is the Gerling company general insurance share company in Cologne.
3. With all cases of damage immediately the office of the DMFV is to be informed, which holds appropriate forms for damage ready. The filled out and signatory forms for damage are to be sent back to the office of the DMFV. The damage preliminary test and adjustment with damage to 2.500€ the DMFV takes over. Damage adjustments over 2.500€ and personal injuries are worked on after a preliminary test by the DMFV von Gerling.

NOTE! With cases of damage all damaged or destroyed things (e.g. flight models) keep, since these can be requested to inspection purposes. Damaged articles may become therefore only after the release by the DMFV entsorgt.

4. a) All developed damage is settled after examination by the DMFV or Gerling, whether they are entitled after the height.
b) With damage, which results from the duplicate of a frequency, the Schaediger becomes at a value of 150€ for each case of damage takes part. For damage to flight models, with those the amount of damage 2.500€ , amount to selfkeep 10% of the amount of damage exceed.
5. With all damage to flight models, which were adjusted, the destroyed material turns into into the property from Gerling.
6. The existing liability insurance for the enterprise of flight models includes models up to a total take-off weight of 25 kg.
Models with a total take-off weight of over 25 kg require a separate permission. This permission can be given in the context of the agency of the Federal Ministry for traffic over the DMFV. The pilot requires a special permission.
For this the DMFV on request gives closer information. For the enterprise this, large-scale models "is not sufficient the normal insurance confirmation (DMFV document of identification). Is necessary an insurance confirmation (policy), which can be likewise requested over the DMFV with Gerling. In accordance with § 37 I air VG cling the owners of flight models with a take-off weight over 25 kg up to a sum of 3.000.000€.


2. Types of insurance:

1. For associations and club members

For associations and for of them with the DMFV announced members is in membership dues which can be exhausted (adult 37? annually and young person 18,50? already contain annually) an overall insurance portion. Thereby following risks and covering ranges are seized:

a) Association liability insurance (verse illusory No. 12/13/73/40)

The insurance protection covers the legal liability of the association and the personal, legal liability of the members of the board of the association as well as all persons, which are assigned by the executive committee of the association to be active for the association.
Examples of the range of application:
- the association uses a flight controller as a check of the air traffic. If requirements for liability from the employment of this flight leader should be made valid, then these can be adjusted over the association liability insurance.
- also requirements for liability, those from statutory meetings or other meetings of the association (meetings of the members, association festivenesses, model construction instruction etc..) to develop can become, over this insurance adjusted.
- requirements of members of the association, that can develop with a manipulation in the interest of the insured association e.g. with care work, maintenance of association areas, use of tractor lawn mowers for Maeharbeiten on the association area, cleaning and maintenance of the association home and the enterprise of workshops, are likewise adjusted over this insurance.
Apart from the use of flight models also the building of ship and automodels is coinsured in the association framework.


b) Owner liability insurance (verse illusory No. 12/13/73/40)

The insurance protection covers the legal liability of the announced and insured members of an association and the announced and insured individual members of the DMFV from the enterprise of flight models, as far as these are operated on the area of the association.
The flight models may not exceed the total take-off weight by 25 kg and not be equipped with rocket propulsion with a propellant charge over 25 g. Remote controlled hot-air balloons and Modellzeppeline are coinsured, likewise model airplanes with Pulsotriebwerken, Turbinen-und gas turbine drive. Slowflyer and hall flight models are likewise insured.
Model rockets with a propellant charge weight up to 25 g are insured.
As if versichtert apply requirements for liability third, which are due from the enterprise of the models before specified within the association framework or in the interest of association. Association framework: Enterprise of flight models on the area of the association, which is used continuously and expressly for this purpose (modellflug).
The enterprise of flight models at places of other associations is likewise insured.
Interest of association: Participation of club members at competitions and public aviation meetings. The area of application of this insurance extends to Europe. Coinsured is also damage of club members among themselves. During duplicate of a frequency the Schaediger becomes at a value of 150€ for each case of loss takes part.
For damage to flight models, with those the amount of damage 2.500€ , amount to selfkeep 10% of the amount of damage exceed.
With the participation in aviation meetings subject to approval on behalf of their association (§ 24 air VG) the insurance protection for DMFV members increases automatically to 3.000.000? for the enterprise of flight models with a take-off weight up to 25 kg and on 6.000.000? for the enterprise of flight models with a take-off weight of over 25 kg.
In form one is granted to foreign participants in meetings of the DMFV, its member associations and groups sub to sidiaeren owner liability insurance for the time of the participation in the meeting insurance protection. The DMFV makes juvenile model flight prospective customers by "youth competitions for free flight model possible", over did not motorize and not remote controlled flight models, the entrance into the model flight haven. Also here juvenile participants, who are not member in the DMFV, are insured.
In the association framework is likewise sucked. Teacher/pupil enterprise coinsures.
Model flight prospective customers can learn the remote controlled modellflug by support of DMFV club members on their association areas. This takes place in the teacher/pupil enterprise. A fixed connection of teacher and Schuelersender is not necessary. The association must belong to the DMFV as member association and take place the teacher/pupil enterprise in the model flight area of this DMFV association.
- With the model flight prospective customers and/or pupils it must concern club member candidates and/or DMFV with more gliedsanwaerter.
- The enterprise of the flight models by the member candidates may take place only under the supervision of a member of a member association of the DMFV.
- The flying operation must be registered before admission of the teacher/pupil enterprise into the flight controller book and after conclusion also its completion.
- The period of insurance for each candidate amounts to maximally 6 months, counted from the day of the first briefing on.
- The insurance protection does not extend to cases of damage, which occurred outside of the area of the Federal Republic of Germany. If a liability claim should be caused with the teacher/pupil enterprise, then the adjustment of damages is completed over the owner liability insurance of the teacher.
To the absolute adherence to the conditions for the teacher/pupil enterprise, specified before, again one refers.
This insurance benefit is premium-free contained with DMFV one and their announced and insured members.

DMFV Foerdermitglieder participate within an DMFV association at the association liability insurance. An owner liability insurance for the enterprise from flight models is however with the contribution which can be paid from promotion members to (adult 19€ and young person 9.50€ annually) contained and cannot not be locked also.

c) Soil accident insurance (verse illusory No. 12/13/1654/39)

With this insurance insurance protection is granted against economic consequences of physical accidents, by which the announced and insured members of an association can be affected.
The insurance protection extends to the borders of Europe and with the following unfallereignissen is granted:
- Accident of a member during the participation in an association meeting.
- Accident with the association work on the soil e.g. job for a workshop or with the distribution of model construction instruction.
- Accident during common association travels to foreign meetings.
- Accident during travels of individual members of an association, if these were delegated from the association to these travels (e.g. participation in meetings of other associations).
There is however no covering during flights in aircraft.

d) Right protection insurance (verse illusory No. 12/13/0055013/91)

The insurance refers to the member associations of the DMFV as well as to their announced and insured members.

Versichtert are in detail:

Compensation right protection
Here member associations or individual members of these associations right protection for the asserting of requirements for compensation can stress approximately third. Example: A member of an insured association participates in a competition of another association. The model of this member is destroyed by the imprudence of another model flier. The Schaediger rejects however the assumption of the costs. Since one cannot agree, the thing goes before court. Here right protection exists for the DMFV member at the time of the execution of its entitled demands.

Criminal law protection
Here member associations or individual members of these associations can get right protection e.g. because of the injury of a regulation of the punishing and irregularity right, if against an insured member the reproach of a negligent criminal offence is raised.
Example:
A member of an insured association flies with its model on the association area, which lies had no ascent permission, however within the 1.5 km zone and would be thus registration-obligated. The police appear; the model flier receives a judgement imposing a fine.
Even if here deliberate acting were present, the model flier has requirement on criminal law protection from this insurance, since the delikt is also negligently committed punishable.
The right protection insurance takes over all costs of the own lawyer, all costs of the opposing lawyer, if it determines the court in such a way, in addition the costs of witness' fees, displays and fees of the possibly judicially ordered consultants.
In principle free lawyer choice exists.
Geopraphisch exists insurance protection for Europe.

e) Deckungsumfangder individually insurance
- Association liability - insurance: 1.500.000€ overall with persons and/or damages to property
- Owner liability - insurance: 1.500.000€ in accordance with allocation after § 37 I sentence 1 air VG
- Soil accident - insurance: 5.000€ in the death 10.000€ in the case of disablement
- Right protection - insurance: 51.130€ for each accident

2. For individual members and for club members

Additional insurances for the private use of flight models

There are many members in the DMFV, which wants to belong no or still to no association and their flight models also outside of an association framework to the employment to bring. These members can be accepted in the DMFV as individual members. For the employment of its flight models outside of the association framework the conclusion of an additional insurance is necessary.
In addition, club members, who are insured already over a member association of the DMFV, have the possibility of increasing and of securing with the additional insurance also for the private use of flight models (outside of the association framework) liability-moderately by the conclusion of an additional insurance their covering sums for the enterprise from flight models to.

a) The covering sum amounts to with liability claims, which are caused by the enterprise by flight models:
- 1.500.000€ overall during the additional insurance form II
- 3.000.000€ overall during the additional insurance form III
- 4.000.000€ overall during the additional insurance form IV
b) The area of application of all additional insurances is world-wide agreed upon.
c) At the time of conclusion of an additional insurance after form II, III or IV an extension of the insurance protection exists over the soil accident insurance for the insured member. Does an accident lead to a temporary inability to work, does become a unique daily allowance lump sum of 250€ starting from that 43. Day of the complete inability to work paid.
d) Premiums for the additional insurance protection become
- for the additional insurance form II 14€ annually.
- for the additional insurance form III 17€ annually
- for the additional insurance form IV 24€ annually
Additionally to membership dues raised.
The costs of the additional insurance are raised always fully for the current financial year (01.01. to 31,12.) independently of when the member decides for an entrance into the DMFV or the conclusion of an additional insurance.
To the additional insurances apply all extensions and/or restrictions, which apply also to the owner liability insurance of the DMFV club members. In particular also the regulation that during duplicate of an approved frequency a self-participation is computed by each damage, see above.
NOTE! Individual members of the DMFV with the private use of flight models do not insure the teacher/pupil enterprise.

3. Exclusions:

With all aforementioned types of insurance also exclusions are present apart from the covering of the insured activity. Like that the possession and the start-up of all kinds are not coinsured of starting hoists, with exception of starting hoists for flight models.
Also throwing articles off from flight models is not insured.

Aviation meetings, in which only flight models up to 25 kg take-off weight participate, are released from the permission obligation § 24 air VG.

The risks from the execution of public aviation meetings are likewise not coinsured. There is here the possibility of locking over the DMFV a premium-free organizer liability insurance sees point V.
The risk from the burn-off down of Osterfeuern or fire works and the maintenance of spectator's stands is not coinsured.
An insurance of model-flight-specific plants e.g. clubhouse, runway or equipment shed is not contained. For this separate insurance is to be locked if necessary over the association or individual persons.


4. Notes:

To associations applies:
The insurance protection, which we defined under point II 1 A-e more near, applies also to model flight areas, which do not possess ascent permission after § 16 paragraph 5 LuftVO. To all members applies in principle:
Absolutely consider the legal regulations and regulations concerning the ascent and the enterprise of flight models.

5. Further insurance possibilities over the DMFV:

Apart from the insurance for the enterprise of flight models within the association framework or for the private use of flight models, designated above, the DMFV on request can obtain the following insurance:

1. Premium-free organizer liability insurance with a covering sum 1.000.000? overall - also for combined meetings model flug/Fallschirmabsprung/Grossfliegerei.
2. Extensive spectator insurance with public meetings in form of a soil accident insurance for spectators at model flight meetings as auxiliary insurance for organizer liability insurance.
3. Switching of an exhibition and transport insurance, whereby flight models and/or ship's models and/or automodels can be insured. The insurance protection extends to and the return motions of the models as well as in the long run the exhibition.
4. Switching of an official travel all risks insurance on vehicles honorary transacts an association, which participate on behalf of their association in foreign meetings, insurance against all risks with their private vehicle here insured.

Ker je bilo nekaj nejasnosti glede zavarovanja pri DMFVju, sem jim pisal in postavil nekaj vprašanj. Ugotovil sem da se dodatna zavarovanja II, III in IV razlikujejo samo po maksimalni vsoti. Veljajo vse tri povsod kjerkoli letiš. Tukaj je še odgovori, ki mi ga je poslal:
